May 17, 2021 – Washington Co., WI – Taxpayers in Washington County have until midnight tonight, May 17, 2021, to file a protective claim form in order to be eligible for a refund for a penalty they paid after the Federal Government issued a requirement in 2017 mandating people have health care.
According to Steve Kjer CPA, “this just came down several days ago and we’ve been trying to notify our clients.”
The statement below is what Kjer is reading to his clients.
“If people disagreed with the Federal Government requiring citizens to have health insurance. A lawsuit was filed against the Federal Government and a lawsuit finally reached the U.S. Supreme Court.
The Supreme Court has decided to hear the case.
If the U.S. Supreme Court agrees that the Federal Government’s mandate is unconstitutional to require people to have health insurance you can get a refund of the penalty that you paid.
If the U.S. Supreme Court rules it is constitutional then you will not get a refund.
The urgency is the statute of limitations for 2017 tax returns expires today, May 17, 2021 at midnight.
A Protective Claim form for a refund needs to be signed with your accountant. That will be submitted to the IRS and extend the statute of limitations.
This information affects people who paid the health care penalty in 2017.”
